Hulkamania runs wild on Gawker Media (THE RIDE NEVER ENDS)

Backstory in a nutshell: Gawker illegally published a sex tape of Hulk Hogan in which he said some racist shit, cost him his career, defied a court order to take it down, and published an article acknowledging that they were knowingly violating said court order. Hogan is suing for $100 million (the estimated value of his career), and the trial started this week. Here's the latest: http://nypost.com/2016/03/09/gawker-edi ... -year-old/
A.J. Daulerio, 41, was sitting ramrod straight in the Florida courtroom during the awkward moment when he was asked on video by Hogan’s lawyer, “Can you imagine a situation where a celebrity sex tape would not be newsworthy?”

Daulerio answered flatly, “If they were a child.”

“Under what age?” attorney Charles Harder asked.

“Four,” he said.

“No four-year-old sex tapes, OK,” Harder said.
You literally cannot make this shit up.

UPDATE: THE RIDE NEVER ENDS

In a clip played for the jury, Hogan said that he didn’t know who the woman was because “the truth is it wasn’t just one brunette … I was running pretty wild there for a few months.”

So unless Gawker and Kotaku have secret butt gold somewhere that means both are going bankrupt.

Or manage to win on appeal. Though that's unlikely at this point.

After the shitshow that was the trial, it is astronomically unlikely that they'll win an appeal.

It should also be noted that this figure from the initial ruling does NOT include punitive damages, which the jury decided to award. Gawker as a whole has been valued at 300 million. This could very realistically kill them. If the settlement doesn't, the fact that no advertiser in their right mind would want to affiliate themselves with Gawker's brand after all this will.

The best they can hope for is a reduction in how much they owe Hogan.

Considering that they indisputably ruined his career through illegal activity, that's unlikely. Hogan asked for $100 million, the jury gave him $115 million plus punitive damages. It's a slam dunk case for Hogan.

I was curious about that bit actually. How much do punitive damages typically pay out relative to the compensation awarded?

According to everyone's favorite site there's no real limit to how much punitive damages can pay out. But I guess the supreme court can limit that if the award is ridiculously too high.
Wikipedia wrote:There is no maximum dollar amount of punitive damages that a defendant can be ordered to pay. In response to judges and juries which award high punitive damages verdicts, the Supreme Court of the United States has made several decisions which limit awards of punitive damages through the due process of law clauses of the Fifth and Fourteenth Amendments to the United States Constitution. In a number of cases, the Court has indicated that a 4:1 ratio between punitive and compensatory damages is high enough to lead to a finding of constitutional impropriety, and that any ratio of 10:1 or higher is almost certainly unconstitutional. However, the Supreme Court carved out a notable exception to this rule of proportionality in the case of TXO Production Corp. v. Alliance Resources Corp., where it affirmed an award of $10 million in punitive damages, despite the compensatory damages being only $19,000, a punitive-to-compensatory ratio of more than 526 to 1. In this case, the Supreme Court affirmed that disproportionate punitive damages were allowed for especially egregious conduct (the trial court in the same case purportedly said "What could be more egregious than the vice president of a company saying, well, testifying and saying that he knew all along that this property belonged to Tug Fork?")[21]

Right, so the behavior of the defendant is a factor in this, and the damages awarded can reach up to $460 million without violating a supreme court ruling. Gawker is FUCKED.

the thing you have to understand about gawker is they are trolls. they've been trolling before some of you were even born ALL PLAYERS ARE OVER THE AGE OF 18

the hulk case is particularly cool trolling because it forces everyone in the media to defend a company that just said they'd publish child porn

Gawker is trying to counter-sue Hogan. It's so cute, they think they have a leg to stand on. Unfortunately, "nuh-uh" is not a valid legal defense.

I dunno why they ever pretended to have values journalistic or otherwise.

Its like a rat cornering itself and slitting its own throat. Totally avoidable and pointless, except for the hulk's wallet.

I think he knows he probably won't win this one. His plan is obviously to bankrupt them and make Gawker LLC completely unappealing to venture capitalists though litigation hell.
