HolyRelying on Jacobsen v. Katzer, the District Court concluded that royalty-free licensing under open source conditions does not preclude a claim for damages.
Breach of contract claims may also be able to address reputational harm and other indirect non-economic benefits that a plaintiff might derive from enforcing open source license conditions.
Essentially, treating (A)GPL as a contract for purposes of law allows it to avoid local "copyright" jurisdictions, and become worldwide, we can all see how that would be useful, surely.Generally, copyright claims may afford plaintiffs more damages and stronger remedies than contract claims. However, contract claims may help a plaintiff pursue a violator’s worldwide conduct in a way that jurisdictional limits on copyright claims might not allow.

IIRC the first deadminning happened because the friend admin said someone had no reading comprehension and apparently this was the straw that broke the camel's back. Then there was an argument about admin policy and criticism about how Godsring picks and favors admins based on how emotionally supportive they are to him and not by their admin ability and effort. Godsring didn't exactly refute this. The rest is history I guess.TheColdSlime wrote:Ok so from my limited understanding on what happened, aran got mad that godsring deadminned their friend for being a control freak, so aran sent a death threat to godsring and his son. When godsring then deadminned aran and didn't explain it, most of the staff left or something.

On this day May 23 - 2017, in order to let players continue to enjoy the Fallout 13 project and allow the further hosting of our servers on Byond HUB, Fallout 13 administration has made an uneasy decision to ease monopoly on the source code.
Developers have tried their best to defend the project, by seeking holes in licensing, and other ways not to surrender, but capitulation turned out the only reasonable thing to do, besides a complete termination of a project.
This day shall be remembered as a day of great shame and disappointment, but also a day when each and everyone got the ability to directly contribute to the project, a day when Fallout 13 was saved from a Great War of Communities, and potential extinction by the course of war.

He really needs to stop being a little bitch about the source code. The only thing he's doing is shoveling more shit on to the pile of shit he's already trying to clean up. I don't see how he can think it's worth it.ohnopigeons wrote:https://a.safe.moe/frVRp.png
